The Department of the Environment issued a notice stating that in its opinion the major planning application (A/2004/0976/F) should be refused. The applicants requested a hearing before the Commission under Article 31(3) of the Planning (Northern Ireland) Order 1991 to discuss the notice. The Commission made arrangements for a hearing but it was subsequently postponed indefinitely at the applicants' request.
The Department has withdrawn its request for a public local inquiry under Article 123 of the Planning (Northern Ireland) Order 1991 to consider a more recent application by the same applicants for retail development on the same site (A/2009/0212/F).
